These Terms of Service ("Terms") govern your use of ProductCompanion (the "Service"), and define the rights and obligations of all parties.

These Terms are accessible and printable at any time via a direct link at the bottom of the website.

Article 2 - Access and Service Description

2.1 Description

ProductCompanion is an online service (SaaS) for product development assistance. It offers:

• An AI conversational assistant to guide users in defining their product
• Capture and organization of key information ("Vital Info")
• A stage-based progress tracking system ("Stages" and "Checkpoints")
• A synthetic view of product information ("Product Map")

2.2 Access

The Service is accessible free of charge from any location to any user with Internet access. All costs incurred by the user to access the Service (hardware, software, Internet connection, etc.) are their responsibility.

Access to the Service requires creating a user account.

2.3 Availability

The Operator uses all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to achieve this.

The Operator reserves the right to suspend, without notice, access to the Service for maintenance operations or for any other reason deemed necessary.

Article 3 - Registration and User Account

3.1 Account Creation

Using the Service requires creating an account. The user must provide a valid email address and create a secure password.

The user agrees to:

• Provide accurate and up-to-date information
• Not create an account under a false identity
• Not create multiple accounts
• Maintain the confidentiality of their login credentials

3.2 Account Security

The user is solely responsible for maintaining the confidentiality of their password and for all activities that occur under their account.

In case of suspected unauthorized use of their account, the user must immediately inform the Operator at hello@productcompanion.xyz

3.3 Account Deletion

The user may delete their account at any time from account settings or by contacting the Operator. Deletion results in the erasure of all data associated with the account in accordance with our Privacy Policy.

Article 4 - Use of the Service

4.1 Authorized Use

The Service is intended for personal or professional use for developing digital product projects. The user agrees to use the Service in accordance with its intended purpose and these Terms.

4.2 Prohibited Uses

It is strictly forbidden to use the Service for:

• Any illegal or fraudulent activity
• Distributing unlawful, defamatory, insulting, obscene content or content that infringes the rights of others
• Attempting to circumvent the security measures of the Service
• Collecting data about other users
• Using robots, scripts, or other automated means to access the Service
• Intentionally overloading the Service infrastructure
• Reselling or commercializing access to the Service without authorization

4.3 User Content

The user remains the owner of content they submit to the Service (product descriptions, conversations, information). By using the Service, the user grants the Operator a non-exclusive license to store, process, and display this content as part of providing the Service.

The user warrants that they have all necessary rights to the content they submit and that such content does not violate any third-party rights.

Article 5 - Artificial Intelligence Features

5.1 Nature of AI Responses

The Service integrates artificial intelligence features provided by third parties (Anthropic). AI-generated responses are suggestions intended to assist the user in their thinking.

5.2 Limitations

The user acknowledges and accepts that:

• AI responses do not constitute professional advice (legal, financial, technical, etc.)
• AI may produce inaccurate, incomplete, or inappropriate responses
• The user remains solely responsible for decisions made based on AI suggestions
• Usage limits (number of messages per day) may apply

5.3 Liability

The Operator cannot be held liable for direct or indirect consequences resulting from the use of AI features, including business decisions made based on generated responses.

Article 6 - Pricing

6.1 Free Plan

The Service is currently offered free of charge in its basic version, with a limit of 50 AI messages per month.

6.2 Pricing Changes

The Operator reserves the right to introduce paid features or modify the pricing of the Service. Any pricing changes will be communicated to users with reasonable notice.

6.3 Refund Policy

Due to the digital nature of the Service and the waiver of the right of withdrawal upon subscription, subscriptions are non-refundable after the start of Service use.

Exceptions:

• Exercise of the right of withdrawal within 14 days (if not waived)
• Major malfunction of the Service attributable to the Operator

Article 6bis - Right of Withdrawal (EU Consumers)

6bis.1 14-Day Right of Withdrawal

In accordance with EU Directive 2011/83/EU on consumer rights, consumers residing in the European Union have 14 days to withdraw from a distance contract without giving any reason.

This period runs from the conclusion of the subscription contract.

6bis.2 Waiver of Right of Withdrawal

By checking the acceptance box during subscription and starting to use ProductCompanion, you expressly consent to the immediate performance of the Service and acknowledge that you lose your right of withdrawal upon first access to the Service.

6bis.3 Refund in Case of Non-Waiver

If you exercise your right of withdrawal without having waived this right, you will be refunded pro rata for the unused portion of your subscription.

6bis.4 Withdrawal Form

To exercise your right of withdrawal, contact us at hello@productcompanion.xyz clearly stating your wish to withdraw.

Article 7 - Intellectual Property

7.1 Operator Rights

The Service, including its structure, design, text, graphics, images, sounds, videos, databases, software, and all other elements comprising it, is the exclusive property of the Operator or is subject to authorization for use.

These elements are protected by intellectual property laws and may not be reproduced, used, or represented without the express authorization of the Operator.

7.2 License to Use

The Operator grants the user a personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with its intended purpose and these Terms.

Article 8 - Personal Data

The collection and processing of personal data are described in the Privacy Policy, which forms an integral part of these Terms.

Article 9 - Limitation of Liability

9.1 Availability

The Operator strives to maintain the Service accessible 24/7 but does not guarantee continuous and uninterrupted availability.

9.2 Disclaimer of Warranties

The Service is provided "as is." The Operator does not warrant that the Service will meet the specific needs of the user or that it will be free of errors or bugs.

9.3 Limitation

To the extent permitted by law, the Operator's liability is limited to direct and foreseeable damages. The Operator cannot be held liable for indirect damages, data loss, loss of profits, or business interruption.

In any event, the Operator's total liability shall not exceed the amounts paid by the user during the 12 months preceding the event giving rise to the claim.

Article 10 - Modification of Terms

The Operator reserves the right to modify these Terms at any time. Users will be informed of changes by email or by notification in the Service.

Continued use of the Service after notification of changes constitutes acceptance of the new Terms.

Article 11 - Termination

11.1 By the User

The user may terminate their account at any time without notice.

11.2 By the Operator

The Operator may suspend or terminate a user's access in case of:

• Violation of these Terms
• Fraudulent or abusive use of the Service
• Non-payment (in case of paid features)
• Conduct harmful to the interests of the Operator or other users

Article 12 - Governing Law and Jurisdiction

These Terms are governed by French law.

In case of a dispute relating to the interpretation or execution of these Terms, the parties will endeavor to find an amicable solution. Failing that, the dispute will be submitted to the exclusive jurisdiction of the courts of Nanterre, unless otherwise provided by law.
